Somehow, this is quickly becoming a “liberal versus conservative” debate on the cable news networks and in the blogosphere. “It’s an illness; cruel and unusual punishment to deny snippage to this woman trapped in a man’s body!”, cry the libs. “I’m not paying for that! He’s nothing more than a pervert!”, cry the conservatives. I say, allow the sex change operation for Ms./Mr. Kosilek with just one caveat…
NO ANESTHESIA.
As long as Kosilek agrees under those conditions, nobody can accuse the State of “cruel and unusual punishment”. Should he not, “too bad, so sad, your ‘nads”…

Judge grants hearing for killer seeking better sex change care in prison
A judge today granted a hearing to a convicted murderer who says she’s being denied medical treatment in prison as she awaits a ruling in her bid for sex change surgery.
U.S. District Judge Mark Wolf ordered a March 13 hearing in the case of Michelle Kosilek, formerly known as Robert. Kosilek asked for the hearing after claiming she’d been denied hair removal treatment and access to a specialist to discuss testosterone levels. She said as a result her body is becoming more masculine. …”
Uh, yeah — he’s/she’s got a point there — not lookin’ too “purty” these days; gotta agree on that one…

After Wolf ruled in 2002 that Kosilek was entitled to treatment for gender identity disorder — but didn’t order sex-reassignment surgery. Kosilek sued in 2005, saying the treatments weren’t enough. …”
Again, let it be done, I say (under the circumstances I gave), and if he/she makes it, set him/her free — price to society PAID IN FULL. I’ve always thought this would be a great way to deal with the pedophiles as well — physical (versus chemical) castration without anesthesia as a CHOICE for the offender and life imprisonment without the possibility of parole for Option Number Two. Go with Option Number One; debt to society PAID IN FULL.
Now, don’t get me wrong; I’m not THAT cold-hearted. I would have no problem with football-sized ibuprofen tablets to be issued to combat the pain (no lortabs, perves — sorry about that one) for a few days following the “surgery”. After all, even with the choice being solely that of the offender, even I would feel it would be “cruel and unusual” of the State to simply give these people two Bayer aspirin every four hours after such a stressful situation, of course.

Tough issue. I’m not crazy about the snide commentary, because it shoots beyond the mark at the overall transsexual community.
As a trannie, I’m not crazy about the negative issues that find their way to us as a result of the outrage over a murderer having surgery.
What this person did was heinous. She was sentenced and punished for this. The sentence did not stipulate denial of surgery as an element of punishment.
What I don’t know is the depth of this issue, the level of sincerity with the individual. I would guess that was well evaluated, because in my experience you cannot play act at having gender dysphoria, it will be ferreted out sooner or later. However… this person is undoubtedly desperate, and desperation can drive someone through the hoops as well.
Overall I’m torn, because goddess, this person murdered someone. On the other, I embrace Pema Chodron’s ‘every living being, without exception – has the power to awaken.’
SRS is not cosmetic surgery, though society has had a lot of fun playing off of patriarchal themes in how it views the issue. We’ve come a long way overall, and we need to move it from cosmetic surgery to the realm of regular surgery – if it is medically necessary, then it is covered.
If the issue for this individual is legitimate, then if the state does not wish to pay for surgery, the next logical step is a separate facility, and I doubt anyone wishes to pay that cost. Absent that, cruel and unusual punishment can be brought into play. In the long run, it is cheaper to pay then not.
So while the outrage is valid on one level, we all know that emotion is left at the door of legal proceedings – or should be.
Excuse this very Liberal person for being very anti Liberal for the momment. Lets be clear on the fact that “He” killed his wife. That is murder no matter what side of the political aisle you come from on this issue.
A woman is dead that was the “Mother” of HIS children. She is going to be dead for a really long time so HE should be in prison for a really long time. Three meals a day, HIS cell, and HIS thoughts on why HE is in jail for murdering HIS wife.
This is a cut and dry case of a “MAN” manipulating libralism and the law from the same bars that a very liberal state put him in for life. Murder of anyone has no biased under the law. HE killed her, was convicted of it and HE should serve the time.
It pisses me off when people point to this as Liberal leaning ideology when we all live by the same laws. Dental work is one thing while serving a life sentence for murder and this issue is just nuts… pardon the expression.

I agree this person murdered his wife, and this person needs to serve the life sentence. I can even ponder no surgery…
but your post goes beyond these things. By invoking continual capitalised HE’s, you question everyone out here who is transsexual, and you mock not only this person, but me.

You and I have never commtitted cold blooded murder. At least I haven’t. I’m sure you have not either. This MAN did. This is not a transgender issue. This is a sick man that is manipulating the system and as a strong feeling Liberal I honestly feel that he is a murderer hiding behind his actions. He killed his wife. He could have left her, divorced her, or just walked away without any consequences and chossen whatever path he thought best for him. Sex change or whatever. It was his life to live. Instead he committed murder. There is no excuse for it and no penalty better than life in prison for HIS actions.
These thoughts from a Die Hard Liberal! Murder is murder and once convicted of it you have no special rights. Fair treatment as a prisoner and healthcare that the average Bay State citzen does not have is all that he deserves.
