The Time Has Come To Re-Establish “Separate But Equal” Judicial And Executive Branches In The United States

It’s gone; our once proud Democratic Republic…

There were once THREE “Separate But Equal” branches of government — the Judicial Branch, the Executive Branch and the Legislative Branch, where there were two houses of Congress — the House of Representatives and the Senate. One house would propose legislation to the other and the result would be either a new LAW or a STALEMATE. It wasn’t perfect, but it was the proposed Democratic Republic of our Founding Fathers and it actually WORKED for awhile.

But then — somewhere along the way — the Legislative Branch gave some of it’s “Separate But Equal” powers to the Executive Branch. They allowed a president “KING” by the name of “Forty-Three” to negate their hard-fought bills, after being ping-ponged back and forth for days, weeks and months, by signing them into laws with HUGE ASTERIXES known as “signing statements”.

Meanwhile, we Citizens who would become victimized by these PERVERTED, DICTATORIAL “LAWS”, would have no recourse but to take these perverted versions of “Constitutional liberties” to the last of the three so-called “Separate But Equal” branches; the Judicial Branch, in our desparate efforts to remain FREE. Yet, somehow, something even stranger than all of the above occured. The Judiciary had become the Legislature by finalizing these “Asterixed Proposals” with the pounding their gavels at their benches. Thus — the “new law” had become finalized by what we now commonly refer to as an “activist judge”, or an “activist court”, or an “activist Supreme Court”, or an “activist Supreme Court Of the United States of America.”

Ninth Circuit Court? Forget about it. You might as well just call them “The Semi-Final SENATE”, with the SCOTUS being the “Final Senate” when it gets down to it. Speaking of the Supreme Court — FORGET ABOUT ‘EM — just call them the “New Republican Legislature” since you can COUNT on them to ratify any shaky, unconstitutional Republican Police State proposal into uneqivocal LAW.

What happened here? When the final “say so” on a new law is determined by a judge’s gavel, overturning the hard work and sweat of 535 of our elected officials, you can call it whatever you want, but DON’T call it “Democracy”. And it’s getting worse…

Federal officials are routinely asking courts to order cellphone companies to furnish real-time tracking data so they can pinpoint the whereabouts of drug traffickers, fugitives and other criminal suspects, according to judges and industry lawyers.

In some cases, judges have granted the requests without requiring the government to demonstrate that there is probable cause to believe that a crime is taking place or that the inquiry will yield evidence of a crime. Privacy advocates fear such a practice may expose average Americans to a new level of government scrutiny of their daily lives.

Such requests run counter to the Justice Department’s internal recommendation that federal prosecutors seek warrants based on probable cause to obtain precise location data in private areas. The requests and orders are sealed at the government’s request, so it is difficult to know how often the orders are issued or denied. …”

Uhmmmm… that’s not “Democracy”, folks. It’s called a “Police State”. It’s called “Three Blended Bureaus of Big Brother”, all working hand in hand in cahoots with each other to hamper Liberty, Freedom, and the version of Democracy our Founding Fathers risked their lives to grant to We, The People. And there is little doubt in my mind that the George Bush’s, the Nancy Pelosi’s, the (SCOTUS Justices) John Roberts’ and Antone Scalia’s of our country would have been hung by the neck, feet flailing beneath their gallows, by the likes of Thomas Jefferson were he alive to witness this CARTEL we now call our “government” today.

Unfortunately, we’ve become a bunch of GOONS in this country today and we deserve what we get. Are you happy with the smorgasboard of Oval Office 2008 “front runners” you are allowing the mainstream media (“MSM”) to DICTATE to you as being your only so-called “only choices” for the MOST IMPORTANT OFFICE IN THE LAND? Your “Thomas Jefferson’s” of today are blatantly abused and ignored by what was once known as the protected group of Citizen Town Criers known as “The Press” in the days of our Forefathers. Ross Perot? “Wacko”. Mike Gravel? “Crazy”. Ron Paul? “INSANE”. Joe Biden? “HARSH — NEEDS TO TELL IT TO THE SHRINK ON A COUCH”. Thomas Jefferson (were he alive today)? FAR from a “front runner” and more like the above. A “dinosaur”. A “wacko”. A “leftist”. An “athiest”.

And why? Because the CARTEL isn’t behind them. “The [so-called] Press” doesn’t APPROVE. And the idiot flipping burgers at Mickey D’s hasn’t heard of them; only hears the anti-rebel Press’s PERSONAL SLANDER of these patriotic individuals and takes that to his nearest voting booth to choose the “lesser of two evils” while forgetting his action was TRULY “evil” — TO THE BONE. “Joe the burger flipper and NASCAR fan” is your SECOND biggest problem in our Democracy, with “The Press” being your first.

THINK. Bring down THE HOUSE, my fellow Americans. These CRIMINALS have ruled us long enough. Vote AGAINST TYRANNY. Restore our Democratic Republic and pay no attention to the polls or our so-called “Press”. Read the blogs if you wish to know the REAL truth.

    this is bad, pretty scary. mothin’ to hide, nothin to worry about though, right?
    at some point they’re really coming down on this sorta-free speech thing happening on our computers. already commerce has been dominated (ebay/amazon/paypal).
    might as well have our ip addresses on our licenses; what’s up with those RFID chips, how they comin’ along?

    As much as I agree with some of your points Gunny, I firmly believe that the only way to return America to Americans is to let Americans vote the elitist bastards out of office as soon as possible.

    Personally, I don’t trust any of the media paid for suggested leaders of both parties and being a Democrat left me with two choices, Bill Richardson and Joe Biden. Neither has one hundred million in the bank to buy the media off so they can talk straight and shoot from the hip because they are beholding to none. Both very qualified men with years of experience and that something else in your gut feeling that tells you this guy is for real and not a sound bite. Today I decided to throw my voice behind Joe Biden one hundred and ten percent and I would suggest you look a little closer at the real Joe Biden. I think you might be amazed at what you find.

    Just my two cents worth…

    GTL- i think a country like France or the Netherlands would take your family in immediately, and they would probably love the publicity (if it were generated)of having an American combat veteran/intellectual/activist seeking refuge on their shores. it’s coming man, you know it, i know it; and Canada ain’t safe anymore, American law enforcement operates up there with impunity, independant of Canadian law enforcement, they’re one step behind us along the police state road- just like most western industrialised nations.
    and, frankly, at risk of sounding like the paranoid pussy i am, i’m seriously considering getting off ‘the grid’. meaning we’re leaving ourselves wide open by continuing to entertain this notion of ‘we’ve got rights and stuff’ on the internet, with phone calls- that’s their game, they give out the rights.
    i respect you, you’re walking on thin ice, that’s why your views have weight, you’re taking a HUGE risk. it’s so easy to go on the net (pun?) and toe the party line, isn’t it?
    i recommend getting your family out of here, you never would, of course (boston cops are going door to door looking for ‘guns’ as i type, 30 min. away from me) where you can continue doing what you’re doing- dissenting in the best way possible, except for not liking Sean Penn. people need to start considering the safety of their families; and by safety i don’t mean simply from violence, but from the fallout of a depression/insurrection, should one occur (it will).

    this is out of control here, like germans in between World Wars, the smart people should be emmigrating fast. bush is a candy-ass, lincoln woulda drown us in the Atlantic by now, especially you.

    Wow. One more case of the law not keeping up with technology turns into a police state conspiracy? A few scattered judges not following the rules turns the US into a cartel? At first I thought this was a satire…

    A few points/questions:
    1. Just to clear the air, cell phone companies aren’t providing records for these cases w/o probable cause, so that much is secure. Also, the warrant is still a prerequisite for cell phone tracking – it’s not on the level of warrantless wiretapping. However, the lack of a “probable cause” standard is still a probable cause for concern.

    2. The federal/state boundaries of these cases seem uncertain. If it’s a federal crime (i.e. crosses state lines), then obviously it’d be a federal official requesting a warrant for tracking. If it’s a local crime, is it possible for the state officials to request a warrant of this sort? Otherwise, it seems a little suspicious that these cases are almost exclusively federal. Then again…in a local (thus small) area, would they really need such a tool?

    3. If you’re in a public place, doesn’t the police officer have the right to follow you around without a warrant or anything? For example, isn’t that what police do on the road? I understand that there’s a bit of a difference between a highway cop wandering around the highway and cops on your tail whenever you’re in a public place to make sure you aren’t breaking the law, but where is this difference spelled out in the law itself?

    4. It seems, therefore, that the main point of conflict would be police using this cell phone tracking for people in public areas vs. people in private areas. Would it then be reasonable to write that difference into law, such that police can track you while in a public place without probable cause but have to obtain a warrant with probable cause for private areas? One idea: restricting the warrant to a certain cell phone in a certain area (or perhaps just to a certain area), determining what standard of evidence applies to that area and requesting the warrant accordingly.

    first of all- Joe Lovell, i respect you for being un-anonymous. and i hope to ‘come-out’ soon.

    secondly, Mr. O’keefe: i tried wording that sentence as carefully as possible for two reasons: i didn’t want to sound like i think i’m a big ‘responsible family man’, because i am not, and also i wanted to make my opinion clear that he WOULD NOT leave, perhaps in spite of himself:

    “i recommend getting your family out of here, you never would, of course…”

    also, you are not required, physically, to be within US borders in order to fight for it.

    at least attack my paranoia for god’s sake.

    One aspect of the situation that many apparently fail to realize is that the large majority of American Citizens do not buy this overblown, overly dramatized and falsified, sensationalistic hyperbole. The majority of Americans have enough common sense to see it for what it is.

    These Citizens will elect another President and another Congress, and the United States of America will continue. In some ways I agree with Mat, mainly in that the Citizens of this country will ultimately prevail through their Vote. I don’t agree with his assessment of Biden, but I do believe in the ultimate wisdom and sanity of the American Public.

    Dave, why should we attack your paranoia? It is VERY entertaining at times.

    As for being nonymous, I have nothing to hide. And I figure that anyone who really wanted to find me in the real world could no matter what I did. Much easier to just be open and stand my ground. And I have the firepower to back me up, as long as Hillary doesn’t get elected.

    I’ve never seen much sense in changing names every 3 months, having 800 email accounts to hide behind, and all the other stuff people do. Guns had to do it because of his job as a wing wiper, and that I can understand. And now he has a rep as THE GTL and can’t afford to change it.

    I think I have 3 email accounts, and two of those I don’t use at all. I think a hotmail and a google or something. Maybe a Yahoo. Not sure.

    i am, in fact, an entertainer by trade, Mr. Lovell. although my politics are supposed to be serious, by myself; and my views are a little ‘hyperbolic’, i admit. (are you happy F&B? i was actually an english major at a major MA university).

    i agree with you entirely Mr. Lovell, there’s no point in hiding behind screen-names anymore, for most of us; it’s like like hiding behind a telephone pole.
